GENERAL TERMS AND CONDITIONS OF SALE

1. FIELD OF APPLICATION
These General Terms and Conditions ("GTC") apply to all purchases made via the website https://www.waltana.ch ("Online Site") and/or through direct communication with Waltana Sàrl ("Seller"). By placing an order, the customer ("Customer") accepts these GTC without reservation.
Waltana Sàrl reserves the right to update or modify these GTC at any time. The version in effect at the time of the order applies.

3. CONCLUSION OF CONTRACT
3.1 The products presented on the Online Site do not constitute binding offers. They serve solely as invitations for the Customer to submit a purchase request.
3.2 A purchase contract is concluded only upon confirmation by the Seller, typically via email or WhatsApp including an invoice. Full payment of the invoice constitutes acceptance of the GTC and a binding order.
3.3 The Seller reserves the right to refuse or cancel any order, particularly if it suspects reselling activity or fraudulent intent. In such cases, the Customer will be informed and refunded if payment was already made.
 
4. PRICES, PAYMENT, AND TAXES
4.1 All prices are listed in Swiss Francs (CHF). Swiss VAT (8,1%) is included when applicable. Prices exclude shipping fees, customs duties, or local taxes that may apply upon importation outside Switzerland.
4.2 Accepted payment methods include:
•    Bank transfer
•    Cash (in person only, within Swiss legal limits)

•    Credit cards (1,7% to 2,7% commission will be applied according to the card used)  
4.3 For international deliveries, the Customer is responsible for all applicable customs duties, import taxes, and fees. These charges are not included in the purchase price.
 
5. SHIPPING & DELIVERY
5.1 Delivery is made to the address provided by the Customer. It is the Customer's responsibility to ensure all delivery details are correct. The Seller is not liable for delivery errors due to incorrect information.
5.2 Goods in stock are typically shipped within 1-3 business days after payment confirmation. Delivery times vary depending on destination and carrier and are non-binding estimates.
5.3 The Seller will provide a tracking number once the goods are dispatched. Risk transfers to the Customer upon handover to the carrier.
5.4 The Customer is responsible for inspecting the package upon delivery. Any damage must be reported to the carrier immediately and to the Seller within 48 hours.
 
6. RIGHT OF RETURN
6.1 The Customer has the right to return a product within 14 calendar days of delivery, provided the item is unused, unworn, and returned in its original condition and packaging, including all accessories, booklets, warranty cards, and protective elements.
6.2 To initiate a return, the Customer must notify the Seller in advance by email. Returns without prior notification may be refused.
6.3 The Customer bears the cost and risk of the return shipment. We recommend using an insured, trackable delivery service.
6.4 Refunds will be issued only after the item has been received and inspected by the Seller. Any damage, wear, or missing components may reduce the refund amount. Refunds are made using the original payment method.
6.5 Custom or special-order watches ("on demand") are not eligible for return unless defective.
 
7. WARRANTY
7.1 All watches sold by Waltana Sàrl are authentic and carry the manufacturer's warranty, where applicable. The serial number is recorded for each item.
7.2 The warranty covers manufacturer defects only and excludes:
•    Normal wear and tear
•    Water damage due to misuse
•    Physical shocks or accidents
•    Unauthorized repairs or modifications
7.3 For vintage or collectible watches without documents, the stated year is based on expert evaluation and is not contractually guaranteed.
 
8. LIABILITY
The Seller is not liable for minor deviations in appearance or description, or for any damages resulting from misuse, improper handling, or unauthorised modifications. The Seller's liability is limited to direct damages caused by intentional or gross negligence.
 
9. INTELLECTUAL PROPERTY
All content on the Online Site (texts, images, logos, product descriptions) is the exclusive property of Waltana Sàrl and may not be reproduced or used without prior written consent.
 
10. APPLICABLE LAW AND JURISDICTION
These Terms are governed exclusively by Swiss law. Any dispute arising from or in connection with these Terms shall be subject to the jurisdiction of the competent courts of Lausanne, Switzerland.
